(a) Inzer Pty Ltd respects your right to privacy and is committed to safeguarding the privacy of our customers and software application users. We adhere to the Australian Privacy Principles (APPs) established under the Privacy Act 1988 (Cth), as amended. This policy sets out how we collect, use, disclose, and protect your personal information.

(b) Personal information means information we hold which is identifiable as being about you, including sensitive information such as health and fitness data.

2. Collection of Personal Information

(a) Inzer Pty Ltd will, from time to time, receive and store personal information you enter onto our software application Inzer, provide to us directly, or give to us in other forms.

(b) You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information including but not limited to fitness and biometric data, workout history, device data, and health metrics collected through the Inzer platform (including via gym equipment integrations, the Quantum tablet system, and the Pro QR mobile integration).

(c) We may also collect information when you provide feedback, respond to surveys, communicate with customer support, or interact with our AI-powered health intelligence features.

(d) Additionally, we may collect any other information you provide while interacting with us.

3. How We Collect Your Personal Information

Inzer Pty Ltd collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our software application, when you use gym equipment integrated with our platform, and when we provide our services to you. We may receive personal information from third parties including gym operators, fitness equipment providers, and health data integrations. If we do, we will protect it as set out in this Privacy Policy.

4. Use of Your Personal Information

(a) Inzer Pty Ltd may use personal information collected from you to provide you with information, updates and our services, including personalised fitness programs, AI-driven health insights, and exercise physiology analytics. We may also make you aware of new and additional products, services and opportunities available to you.

(b) We may use your fitness and health data in aggregated and de-identified form to improve our AI models, conduct exercise physiology research, and develop our platform—including research partnerships with academic and life sciences institutions. We will not use your individually identifiable health data for research purposes without your explicit consent.

(c) The Application may make third-party social media features available to its users. We cannot ensure the security of any information you choose to make public in a social media feature.

(d) Inzer Pty Ltd may contact you by a variety of measures including, but not limited to, telephone, email, SMS or mail.

5. Disclosure of Your Personal Information

(a) We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.

(b) We may disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.

(c) We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Inzer Pty Ltd, its application, website, customers or third parties.

(d) Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia, including but not limited to the United States. Where personal information is transferred overseas, we take reasonable steps to ensure that overseas recipients handle your information in a manner consistent with the Australian Privacy Principles.

(e) If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer, to the extent permissible at law, our user databases together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under a confidentiality agreement.

(f) By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy.

6. Security of Your Personal Information

(a) Inzer Pty Ltd is committed to ensuring that the information you provide to us is secure. We have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. These measures include encryption of data in transit and at rest, access controls, and secure cloud infrastructure.

(b) The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us, although we take measures to safeguard against unauthorised disclosures.

(c) In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

7. Access to Your Personal Information

(a) You may request details of personal information that we hold about you in accordance with the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information which we hold about you, or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at info@inzer.com.au.

(b) We will respond to access and correction requests within 30 days. We reserve the right to refuse access in circumstances permitted by the Privacy Act.

8. Sensitive Information — Health and Fitness Data

Given the nature of the Inzer platform, we may collect sensitive information including health and fitness data. We will only collect, use and disclose such sensitive information with your consent or as required or permitted by law. You may withdraw consent to the use of your sensitive information for non-essential purposes at any time by contacting us at info@inzer.com.au, noting that this may limit certain features of the platform.

9. Complaints About Privacy

We take complaints very seriously and will respond within 30 days of receiving written notice. 10. Opt-Out Right

You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes available on your mobile device or via the mobile application marketplace. You can also request to opt-out of marketing communications via email at info@inzer.com.au. Note that opting out of data collection may limit your ability to use certain features of the platform.

11. Changes to This Privacy Policy

We may change this Privacy Policy from time to time. All modifications will be effective immediately upon our posting of the modifications on our website. Where changes are material, we will use reasonable endeavours to notify you by email or in-app notification. Please check back from time to time to review our Privacy Policy.

12. Software Application and Data Collection

12.1 When You Use Our Application

When you use our application we may collect information such as mobile unique device ID, IP address, mobile operating system, browser type, and information about the way you use the Application. This information is used in an aggregated manner to analyse how people use our platform so that we can improve our services.

12.2 Fitness and Equipment Data

When you use gym equipment integrated with the Inzer platform (including via the Quantum tablet system or Pro QR code integration), we may collect workout data, exercise metrics, equipment usage data, and health performance indicators. This data is used to power AI-driven fitness insights and personalised programs.

12.3 Cookies

We may use cookies on our software application. Cookies are small files which identify you when you return to the application and store details about your use. You can choose to reject cookies by changing your device settings, though this may prevent you from taking full advantage of our application.

12.4 Automatic Collection

The Application may automatically collect information including device type, unique device ID, IP address, operating system, and usage data.

12.5 Third Parties

Our application may have links to other applications or websites not owned or controlled by us. Inzer Pty Ltd is not responsible for the privacy practices of those third parties. We encourage users to read the privacy statements of each application or website that collects personally identifiable information.

12.6 Geo-location

We may use GPS technology or similar technology to determine your current location to display relevant services and gym locations. We will not share your precise current location with other users or partners without your consent.
